NOTICE TO POMELO PARK IRRIGATION WATER DELIVERY DISTRICT

 

EMINENT DOMAIN ACTION

 

Since August 2024, the Pomelo Park Irrigation Water Delivery District (“District”) has worked to restore access needed for the operation, repair, and maintenance of District infrastructure after access was blocked by the construction of a concrete masonry unit (CMU) wall within the southwest corner of the Public Utility Easement (“PUE”) at 3516 N. 35th Place. This PUE has served as the sole access route to District Standpipe 3510 for more than 41 years.

Over the past 21 months, the District has made multiple efforts to resolve the matter without litigation but was unable to reach an agreement.  

 

To restore access, the District has initiated an eminent domain action involving the property located at 3516 North 35th Place, Phoenix, Arizona 85018. As a result of the legal action and associated costs, District property owners should expect an increase in the District-related portion of their property taxes.
